ListingsAlive – Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you,") and ListingsAlive (“Company,” "we," "us") governing your access to and use of the ListingsAlive website, applications, and services (collectively, the "Platform"). By creating an account, purchasing a subscription, or otherwise using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.

3. Subscriptions & Billing

  • Plans. We offer "Starter," "Professional," and "Agency" subscription tiers. Plan benefits and pricing are described on the Platform and are subject to change with prior notice.
  • Automatic Renewal. Subscriptions renew automatically at the end of each billing cycle.
  • Payments. All fees are charged via Stripe. You authorize us to store your payment method and automatically charge the applicable subscription fee, taxes, and any overage charges.
  • Past-Due Accounts. If a payment fails, your account may be placed in past due status. We may suspend or limit service until payment is successfully processed.
  • Subscription Management. All subscriptions are final. You may manage your subscription in the Billing section.

4. Intellectual Property

We retain all rights, title, and interest in the Platform, including software, branding, and templates. Subject to an active subscription and compliance with these Terms, we grant you a limited, revocable, non-exclusive licence to use the Platform to create and download videos. You own the final rendered videos you generate, including all intellectual-property rights therein, but not any underlying algorithms, prompts, or templates.

5. Acceptable Use

Users must not:

  • Upload content that is illegal, obscene, or infringing;
  • Reverse-engineer or attempt to access source code;
  • Use the Platform to create videos that violate advertising or fair -housing laws;
  • Transmit viruses or malicious code;
  • Resell or sublicense the Platform without written consent.

6. Service Availability

We strive for 99.9 % uptime but do not guarantee uninterrupted service. Planned maintenance will be announced in advance whenever possible.

7. Disclaimers

The Platform is provided "as-is" without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Generated videos are created by AI and may contain errors; you are solely responsible for reviewing and approving content before public use.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Platform shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Indemnification

You agree to indemnify and hold harmless ListingsAlive and its affiliates from any claims, damages, or expenses arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.

10. Modifications

We may modify these Terms with 30 days' notice via email or platform banner. Continued use after the effective date constitutes acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws principles. Any disputes shall be settled exclusively in the competent courts of Amsterdam, unless otherwise required by mandatory law.
